Assault is not battery. It means he said something threatening, he didn't hit anyone. And he was only charged, not convicted.

Assault in the Criminal Code of Canada refers to any unwanted physical contact.

Saying something threatening is called, believe it or not, Uttering Threats. :sarcasm:

You're right about there being no conviction yet.

No accusations and not charged as per Monday night ... All of a sudden twitter is saying Beaulieu Senior has been charged. A bit confused.

FYI, Patrick Ducharme is a top criminal defense lawyer in Windsor. They picked a good lawyer to represent them.

Well... there goes the speculation on how the hell Beaulieu learned to fight like a mad man. He's got some good paternal behaviour influencing him apparently :P

What's the worst that could happen if Nathan is charged? Community service?

The worst is a criminal record which would be serious as he might not be allowed into the US. He would hope, if guilty, to get it into an Adult Diversion program ( Crown has discretion ) which takes it out of the criminal system and so no record, or, to get what is called a Discharge through the court, which again results in no record. This assumes a simple assault, if its more serious then he has a problem.

That leads me to ask. Khabibulin did jail time in the summer like 3 years ago. Pavelec got caught drunk droving. Those guys have a criminal record for sure. There must be a way to pass around that because it's their job to go in the U.S.

Anyone could clarify that?

I don't think they sweat DUI convictions at the boarder, probably lose too much tourism. This is just US policy so Im guessing you can hire people, like a lawyer, to deal with US officials to see that he can get in and out. Also could depend on Khabibulins US immigration status, dual citizenship etc.

Here's a brief explanation:

If criminal = millionaire / famous then free pass

If criminal = regular Joe then do not pass go, do not collect 200$ and stay on your side of the ****ing border.
