The league will make it so players who’s contracts with Team A are bought out by ANY TEAM cannot return to Team A for one calendar year

If they dont youll see this a lot as itll be the next way to reconstruct contracts, which the NHL is very much against

Team A (Washington) no longer wanted their player on his current contract as it was disturbing their salary cap. They traded the player to Team B (Colorado) who then bought him out, and then the player signed back with team A.

Its no different then reconstructing s contract (which is not permitted in the NHL) and you already cannot sign a player your team buys out for one year.

Lets not act like that wasnt the full intention of the series of moves. And even if it wasnt by some grace, it is a clear redo on a contract for a player and team that had an existing contract just a month prior.

Washington did not like Orpik’s cap hit and got Orpik back at a lower cap hit within a years time. Its clearly them trying to circumvent his previous cap, and while it is within the rules Id expect it to be barred in the next CBA since its intentions are the same as most cap circumvention methods

1) there was no reason to even think avs were gonna buy him out.
2) the avalanche decided they were gonna buy him out after the trade
3) he was put on waivers where anyone could have had him
4) after released he could have signed with anyone
5) month goes by and his only offer is washington
6) he is supposed to do what?

He cant sign with Washington or Colorado then. If that means he has to retire then thats how it is.

Im very confident this will be in the next CBA as it breaks spirit of the cap circumvention prevention

so orpik is supposed to be penalized because the team he wanted to play for bought him out?

Orpik is getting paid though. Most of his original contract. Players get cut all the time. This is akin to it, as he wasn’t seem as being worth t money he was getting. No fake malady being constructed. No contract with a lot of 1m years at the end.

It takes 2 to tango. The Caps had to forfeit a terrific goalie to make this work. They paid a penalty. Were this not able to happen, Colorado would have had to give up a lot more to get the player they wanted.

In the end, the point isn’t to allow a team to “freely” circumvent the cap and bad contracts given. This was not done freely by the Caps.

Just my opinion

If the league gets rid of this loophole in the next CBA, players would 100% be against it because that's one less interested team for negotiations, and for teams I don't see how it would reduce spending or take any power from individual players so what's the point of giving something up to close it?

Sure, technically.

If there's no rule that says you can't re-sign a guy in this situation, then what can you do, but the Caps did basically just renegotiate a contract. All it cost them was a backup goalie. The only reason Colorado took the contract to buy out for just a backup was that there was 1 year left on it, so it won't hurt the Avs for too long, but nobody will make too big a deal about it before the next CBA negotiation because some other team might be in a similar situation one day and will want to be able to do this too.

No rules were broken, but it is an example of the spirit of the law being sidestepped. This is why teams pay lawyers of some sort to figure out all the contracts stuff.
No one forced Avs to take him or buy him out. If Avs didnt buy him out, Caps couldnt sign him... It was a cap move which happens all the time. When Avs bought him out, every team could sign him.

I'm not saying Washington aimed to circumvent the cap and colluded with Orpik to do so, but they have (even inadvertently) set the ground work and precedent for other teams to do so in the future.

Needs to be fixed regardless.

Like as if The players union is going to defend an over 35 player who only has two teams wanting to sign him, and both were a part of a reconstruction of his comtract

Im surprised the league even approved this.

I thought I heard them say a player couldn't be traded, then bought out (with CBOs) then resign with original club in the matter of a month.

I don't think the 1st 2 are true, in fact I'd be shocked if Sakic didn't tell Maclellan he was releasing Orpik to make sure Avs had priority, plus Sakic said he was releasing him like an hour after the trade. What would make it a CBA violation is if the trade was contingent upon his release.

well techincally the buyout wasant part of the deal so therefore he was just a normal free agent

you might be thinking of the lecavalier situation but that was an amnesty buyout which didnt count against the cap

Im done lol. You keep making it about what teams were ‘thinking’ like as if im some mind reader.

You keep thinking about what teams were or were not colluding and ill remain within reality where Brooks Orpik now plays for the Washington Capitals on a new contract before his old expired. Teams cannot buyout and re-sign their own players but you think its okay if another team does it, yet you cant see both provide the exact same relief which is a new, better contract to replace an old, worse one
