I don't know about American laws, but you aren't supposed to handle any electrical device while you're driving here, that includes your sat nav / portable GPS.

It's up to local districts and states to make their own rules here. Where I live, handling a device alone is not a crime.

If you were seen using your phone while driving and get charged for it, you committed the offense. Unless you have some kind of proof that you weren't, then you're gonna lose.
