Filming the scout, yes. But the Patriots also admitted that they filmed the sideline. That could prove to be a problem.

They admitted independent film contractors filmed the scout and the also the responsibilities of the scouts work on the field- I imagine it’s a video of the scout breaking down something the bengals are doing on the field

Like you said, should be easy to prove. But then again these things never go smoothly since the league is incompetent

But seriously, it's probably a he said/she said situation, and the Patriots don't exactly have much credibility when it comes to videotaping. They can have all the evidence they want showing that these people were there for the "Do Your Job" video, but there will still be plenty of people that will think it was nefarious.

As @CDJ said, logic would suggest that the smartest organization in the league wouldn't be dumb enough to blatantly cheat in the same manner as they got caught doing previously, but we don't exactly live in a logical world.
