This settlement makes me wonder what the NFL was so afraid of that they were willing to settle for almost $800 million. Were they afraid of how high the number could go if it went to court? Or was there fear of what discovery might bring up?
Most of the discovery was already completed.
IMHO the leagues' biggest worries, in no specific order, were:
1) the items turned over in discovery being made public during the trial. Which would have included several owners, Goodell, etc being forced to testify under oath.
2) the Judge requiring several owners to turn over personal financial statements in order to calculate potential punitive damages. These were due a couple months ago.
3) Kroenke trying to get out of the indemnification agreement.
