Law suit of the day: Nirvana sued for baby cover

The "baseball game comment" was quite weird. Not really sure thats what I would think of.

Anyhow, its a legendary cover and hes just trying to get a pay day for it. Sad thing is that would never make it to print in todays supercharged PC age.

The worse thing about these types of lawsuits is that even it gets laughed out of court; each defendant still needs to lawyer up. Just thousands of dollars needlessly spent to defend themselves from some clown who decided he was suing them. They can't even make a counter suit because there is nothing to gain from it. What a complete waste of time.

So basically he is suing because the surviving members of the band didn't come to his gallery show....
“I was asking if they wanted to put a piece of art in the f***ing thing,” he said. “I was getting referred to their managers and their lawyers. Why am I still on their cover if I’m not that big of a deal?”

That makes him look even worse than I initially thought.

What a tool and what terrible logic.

Also, I assume it's been said already, but it's very amusing how the cover is of a baby chasing money and here we are.

Honestly, this is the rare situation where I wouldn’t mind seeing a quick counter-suit to wipe this asshole out. He’s working toward Martin Shkreli levels of pretentious Chad-ness.

The best take I’ve seen on the situation: nobody would have any idea that this dude was the Nevermind baby if he didn’t go around telling everyone all the time.

They still have to file documents and explain to the judge why the lawsuit is frivolous and should be dismissed. It sounds simple but messing up could be a lot more costly than whatever lawyer fees they would pay for proper counsel.

Here is something one of my lawyer buddies has said he would ask if he worked for the defendants.

"Sir, in your life time, besides the original photo, have you or anyone in your immediate family made money directly off of the photo?"

The guys lawyers will objection pretty quickly as the guy and his family made money off of the photo by charging for interviews and autographs--prior to the lawsuit

This is just procedural stuff right now.

The funny thing is the money amount is actually fairly low, so this is going to be one of those costs of litigation versus costs of settlement things. I think most people assume this lawsuit is frivolous - and it certainly seems like it is - but the standard to pass a motion to dismiss is pretty f***ing low and I would be shocked if this case was dismissed.

Based on his characterization of the photo as child pornography, wouldn't he technically have to plead the 5th to that question?

I would think he is a step removed from liability on that front.

I mean... the implications of this would basically mean anyone who possesses or sold a copy of that record are guilty of a crime. It's kind of wild.
