I think there's a misunderstanding here. Hartnell isn't waiving his no trade clause so he can be traded to Las Vegas. From all I've read discussed, the theory is that the CBJ would ask him to temporary waive his no trade clause for the Expansion Draft. Then they are not required to protect him in the Expansion Draft and can protect another player. The theory is that there'd be no way LV would waste their CBJ expansion draft pick on him.
It was expressed by local beat writer that Hartnel and Jarmo have basic agreement to allow him to finish his contract in Columbus. This came out of last year's trade deadline when Hartnell agreed to waive his no trade clause, after no trade was made, the two basically agreed not to put him through the whole process again.
