Grievance rights belong to the union, not to the player.
PA always looking to not allow the NHL to set precedence in doing something that would be negative to a player. Bergland might have been fine with it, but another player in the future might not but if the PA doesn't grieve in the past, then the standard gets set moving forward.

I’d guess this was settled similar to the Evander Kane settlement. Chicago pays Perry an amount equal to the remaining salary owed on his Hawks contract, minus the salary/bonuses paid to Perry by the Oilers.

While exact details of the settlement are unknown, the key in this case is it cannot be used as precedent in any future termination conversations. The players’ association wanted to make sure guaranteed contracts will be protected as much as is possible.

So his contract get's terminated with cause and he still ends up made whole?

I’m sure the settlement between the parties includes a clause where both sides agreed there is no decision on whether or not Perry’s contract was justifiably terminated for cause.
