TSNRyanRishaug 5:45pm via Twitter for iPad A huge amount of food was just seen delivered into NHL offices. Looks like another long night ahead.
Last time player vote to disclaim was 97% - will once again pass with overwhelming support - it's go time
...
Now authorized to disclaim since need 50% +1 MT "@RealKyper NHLPA has received 75% needed votes to file disclaimer."
...
No shock here players have authorized - now need to seriously consider disclaiming if not close by around Monday
...
As we saw with NBA, if NHLPA disclaims NHL now negoates with lawyers of individual players since NHLPA can no longer collectively bargain
...
It's not a CBA negotiation anymore - it becomes settlement talks related to a lawsuit now - so talks converted from CBA to settlement
...
Stephen Fehr is not with NHLPA - he's outside counsel so yes he could negotiate for a player - in part logic of keeping him outside counsel
...
Correction - Kyper says have 75% of needed votes and not 75% have votes yes
...
17 days of NFL mediation didn't work nor did few days of NBA mediation; sports labor disputes don't profile for settlement at mediation...
...However it certainly doesn't hurt that they are still meeting
...
NBA agreed to sign waiver that provided that post disclaimer talks would not be used as evidence of bad faith
...
Absence of waiver won't preclude settlement negotiations post-disclaimer
...
If the NHLPA disclaims - and that can be as soon as tomorrow at 6:01 - they do so to try and get this settled in short term and save season
...
To answer questions: (1) It would not be a surprise to see the NHL disclaim interest tomorrow almost immediately following 6pm
(2) Disclaimer not necessarily sham; look at things like whether NHLPA engaged in talks and whether there is intention to re-form PA later
(2) While disclaimer certainly provides clear benefit to players can't say unequivocally sham - employees have right not to be unionized
(3) Disclaimer is designed in short term to save season
(4) Bettman has said if NHLPA disclaims season over; I'm not convinced that is case; only thing that ends season is deadline for season
...
(5) If disclaim Fehr no longer leads talks - it would be lawyers negotiating on behalf of indiv players; S. Fehr as non-PA lawyer involved 2
...
Why did Fehr no disclaim first time? Thought sides were close - maybe he believed in Kris Kringle
...
Disclaimer not done in court - Fehr sends letter to Bettman advising of disclaimer - then lawsuit can file
The PA hired Fehr, paid him a whack of dough, re-jigged its entire structure and gave him a bunch of other perqs in the belief that they’d acquired an unbeaten super-heavyweight capable to turning defeat into victory.
...
But he’s still going to have to deliver.
We’re closing in on the bottom of the ninth and 700-plus players have bet hundreds of millions of dollars in salaries on Fehr coming through with a grand slam to prove the NHLPA did the right thing in unseating Kelly in the middle of the night and giving the keys to the union to Fehr.
...
Presumably, that victory will emerge in the next few weeks, because if it doesn’t, Fehr will be exposed as the wizard behind the curtain, his calculations revealed as way off the mark.
Given his spectacular victories in baseball, he gets the benefit of the doubt here. We’ll assume he’s going to win this thing. What remains unclear is how, and this much is true; dissolving the union and plunging the NHL into a period of utter chaos won’t count as a victory.

Daly also tells me the reports out there that the lockout is over and a deal is done is "not true."

Am told progress has been made in NHL labor dispute but there are some unresolved issues and it is NOT done yet.
