If I do a spin in the middle of the ice and I accidentally hit someone in the face with my stick, it's a penalty.

Intention doesn't matter. Elbowing is hitting someone in the head with an elbow.

True, but with the amount of things that go uncalled in a game, an unintentional elbow isn't something to make a big deal about. Players do worse on a game to game basis intentionally. 2 minutes at most. Not the 5 minute major people are making it out to be.
