Honestly, I think the instigator should not be applied in cases where a player is getting called for a penalty. For example, clean hit and a fight ensues with one player engaging the other (instigator applies). Dirty hit (like Tkachuk's) that is getting penalized and Hamonic steps up, the instigator shouldn't apply.
