#1) I think at this point empirical evidence strongly suggests the delay of a second Kane hearing is not due to the Arbitrator being unavailable.

#2) I don’t believe either party—NHL or NHLPA—has the power to unilaterally delay a second hearing if the other party wants it to happen.


Hence I’m left with these conclusions:

a) Neither the NHL or PA wants the second hearing to happen at this time.

b) Possibility the delay invokes Kane’s bankruptcy case. Note both parties would have to agree to delay.

c) Possibility the NHL and PA are negotiating a settlement.

Sounds like the Sharks may have escaped dead cap space going forward if the settlement $ is all being applied retroactively to the 2021-22 cap.

Crazy stuff. I can see why the NHL and the Sharks/Oilers wanted to just make all this go away. It wasn't a slam dunk arbitration and everyone is happy, more or less, with the outcome with no future penalties/etc.
