Does the NHL call the instigation/3rd man in penalty correctly?

it just seems like this rule is so inconsistent and refs have different interpretations.

Take for example: last week caps and Bruins are playing and orlov and Marchand are "roughing" each other and a caps player comes in and pulls Marchand off and he goes flying into the boards.

Tonight:


Tom Wilson gets an instigation penalty here

Now this isn't a complaint about the game tonight, it just seems like there's no real understanding of this rule

Did he get an instigator or just an unsportsmanlike for continuing to hit him while he was down on the ice? Can't call an instigator when they both drop them on a face-off.

But, to answer your question, it is a subjective call with leeway given to non-fighters while fighters will be given misconducts and the such whenever possible.

Edit- Box shows double-roughing minor. Not even a fighting major.

Instigator/Aggressor (not sure if it's in the NHL rule book)/Third man in are purely discretionary game management calls that have next to no meaning in an NHL game. Otherwise something like this would result in 1-2 ejections and 9-14 minutes in penalties


What was called- Weber 4 for roughing, Kadri 2 for roughing
What should have been called
Benn 2 for roughing- Kadri two for charging (depending on your opinion of the hit), Weber 5 for fighting, 2 for instigating, and a game
