Beach's lawyer asks judge to proceed with discovery

To quote:

"A lawyer representing former Chicago Blackhawk Kyle Beach and a former high school hockey player who was abused by one-time Blackhawks video coach Brad Aldrich has asked a court to allow her to resume pursuing records documenting how the team has addressed abuse allegations made by Beach and others.

The document discovery process was placed on hold by a judge in Cook County Court in Chicago in mid-July, pending the Blackhawks’ motions to dismiss lawsuits filed by Beach and “John Doe 2,” a former high school hockey player in Michigan who was abused by Aldrich in 2013.

In a motion filed Friday, Susan Loggans asked a judge to proceed with discovery.

“While [Kyle Beach] was prohibited from discovery, the defendant hired and paid for an ‘independent investigator’ [Jenner & Block] who interviewed over 100 witnesses,” Loggans wrote in her motion. “[Beach] cooperated with this investigation and the report is now on file with this court. In the meantime, [Beach] learned information from this report to which the defendant only had access. For example, [Beach] learned that the defendant had ‘lost’ the personnel file of the assailant, Brad Aldrich.”"

Without having read all the court filings, on principle Chicago should have a strong legal basis for dismissal under Illinois civil suit statute of limitations. Article makes it appear that Chicago is still willing to settle with Beach though.

It does seem the Blackhawks have the law in their favour. They did note they would like to compensate and settle out of a moral obligation. I'm curious if they primary goal is to be found not guilty or to save money. Would they cut a check to make this go away?

It is a unusual situation. Normally in lawsuits you fight tooth and nail to win. Even if Chicago could get the lawsuit dismissed they’d likely be better off for image (business) reasons to reach an acceptable settlement with Beach.

Tangent. Walsh can toss out this allegation without verified facts. Reporters need verified sources. Have to wonder if more comes from this.

Are all of Beach’s claims against the Blackhawks barred by the Statute of Limitations, or just some? I haven’t read the complaint or the motion to dismiss.

In any event, I suspect the Blackhawks’ motion is maneuvering to bring Beach’s settlement demand down.
