I believe the list are UDFA as in ones you can sign as soon as their season ends. Kerfoot isn't a UFA until Aug. 15 so the Devils still own his rights until then. Basically he's this year's Vesey except with much lower expectations (more so considering he's the captain for Harvard this year).
If his team gets eliminated earlier, he will have a lot of incentive to sign with the Devils (and burn the first year of his ELC right away).
