a question about anti-trust laws

    does it apply only to industries where there is no competition? If there was two or more competing leagues (or enterprises), would anti-trust laws be waived?

    It seems to me that the nhl is no longer a monopoly. Players are free to go to europe, russia, etc. There is also the IMG tour. The wha supposedly starting next year.

    Could the nhl argue before the nlrb that collusion is no longer applicable because players can play elsewhere? Is this what Jacobs was talking about when he said:

    It isn't whether I come back with this mix of players or that mix of players, because sooner or later, we're going to be paying more money than anyone else is for hockey. Hockey players will migrate to us because it's the highest-paid group and we will eventually, if not instantly, have the best players in the world. It may not be next year but it will be eventually

    What Jacobs said would support antitrust actions against the league. He's basically saying that if the players want to make NHL money, they have to play in the NHL. If all it took were the existence of another league, the NHL could point to the UHL.

    To get a good sense of this issue, you should track down articles from Major League Soccer's antitrust dispute. They were able to successfully argue that the league was not involved in restraint of trade. The fact that players could make equivalent, or even better, salaries in Europe and South America helped decide the case.

    weren't there a number of players making million dollar salaries in europe / russia? If the NHL maxes out salaries at 2 mill, then the players have an equal opportunity to earn as much money in Russia or sweden.

    Did the nhlpa shoot itself by encouraging its members to play overseas?
