That seems like something that they should've gotten permission to use as a common courtesy, but I personally don't see the grounds for the lawsuit from any legal standing personally. That seems like the epitome of fair use.

And for crying out loud, it was for a cover song, too.

It’s certainly a interesting “fair use” legal question.

It’s not like the skaters were profiting from use of the song.
