Selling without licensing rights?

I’m curious how are small online companies such as glass bangers, bring back hockey, etsy stores etc. are able to get away with selling nhl team apparel? There is no way most of these companies get licensing rights. So how do they do it?

They do it.

Until if/when they receive a "cease and desist" letter and/or other legal remedies.

I recall many years ago I purchased a self published e-book talking about how to sell photos taken at game. But nothing of obtaining legal rights to do so. (Most pro sports require two licenses/royalty payments - one to league/team for use of trademarked logos; and the union to use name/image of players.)

(And some leagues/unions have a high entry to do so. ECHL ~$1000/year combined.)


Note that some just use team colors, but not name/trademark.
