Dept. of Labor dismisses NHLPA complaint

From the "Gosh, who could possibly have forseen this one coming" dept:

"TORONTO - The National Hockey League Players' Association announced that the U.S. Department of Labor has notified the NHLPA that it will not proceed on any of the complaints brought against the NHLPA by attorney Robert Lanza, who represents Trent Klatt, Chris Chelios and a small group of players."

Actually, the US DOL did not rule at all on the merits of the case. It just declared that it did not have any jurisdiction, since the NHLPA is based in Toronto.

But the Department of Labor, which investigates disputes or wrongdoing in U.S. union elections, eventually ruled that the Toronto-based NHLPA did not fall under its jurisdiction.

Klatt et al could refile their complaints with the appropriate Canadian Labour Board, but it is unlikely they would prevail. Yes, their were violations on Saskin's first vote, but the subsequent secret ballot approval undercuts the dissidents complaints.

Bottom line is, there is no coincidence that the "rogue" group is basically the exact size of the amount of "no" votes for the last CBA.

I doubt they would pursue anything in Canada. Most of this has been about an attempt at a power grab by Bob Lanza. If he cannot be the knight in shining armour (which he cannot, as he is not called to the bar in Ontario), I doubt he would have much interest.
