Cody Ceci sued for 8 million for freak accident

    I am pretty much exclusively talking to the number of people in this thread that seem to think they would want to trade places with her because she is going to get some amount of money. I still find it odd that people would be offended by a person with the kind of injuries she has being paid out by an insurance company but hey I'm just an average guy who likes my skin to stay at a nice and normal temp.

    Personally I find the "lucky" and "sign me up" types despicable, which is why I like the way the Canadian system is set up.

    But at the same time, and while nothing against her and her situation, that support for the system is why I point out that "Omg that's terrible, she should get all the money" isn't how things work in Canada. I wouldn't wish what happened to her on my worst enemy. But at the same time when you look at the claims in the context of legal precedent it has every indication of a well off family with a legal background gouging the system.

    Oh man, some of these comments are ****ed up. I had a patches of second degree burns on my thighs and that was excruciating. I couldn't even go near ****ing apple pie for months because I had it that day right before I got burned. Can't imagine what she's going through, she's going to have permanent and emotional damages for the rest of her life. I'd get every cent available.

    The case really doesn't have those indications at all. These kind of cases proceed on contingency, which gives everyone, regardless of income, access to the same lawyers, as they don't have to pay them up front. The lawyers will take on any case they feel they can win.

    Her claims are also totally normal. She won't be getting any kind of windfall from the courts or the insurance companies. It will be up to her to prove the largest portion of the claims, which is future income loss. As she was employed as a Yoga instructor and business owner, who's physical appearance was important and visible during her employment, physical deformity will be relevant to her wage losses as well as her pain and suffering.

    8 million just seems like a massive amount to me, but that's coming from someone who hasn't gone through this. So take my opinion with a grain of salt.

    I broke things down claim by claim in post 286.
    The $6m in lost income one is really the only one that is subjective enough to not look ridiculous against award precedents / ruling caps, and it's going to take some serious tapdancing to back up. Working in an SME I get that, go in guns blazing with optimistic projections.

    The other 2.6 is largely shock & awe fluff

    6 mill in lost income?

    is she never working again? was she a super modal? say she worked for 50 years--that makes 120k a year--what education does she has to back up making 120k a year

    Sure, anything involving an open flame is inherently dangerous, and people probably do stupid stuff with them everyday, but cooking appliances at least serve a purpose and have some semblance of damage control/containment. Having an open flame on the middle of a table because it’s pretty is one of the dumbest things I’ve ever heard.

    You’re right that there’s most likely a lack of warning/illusion of safety with things like this though. I’d imagine a big yellow skull-and-crossbones sticker slapped on the thing kind of defeats the “Oh, so pretty” purpose. I still think it’s ****ing stupid.

    Okay people...no one expects her to actually get $8 million. That's the initial claim, which then gets negotiated down. You also have to put the highest possible amount in the claim, as you can always go down with your figures, but it's extremely hard to go up.

    what is her current job or the job she had prior to the injury? what was she currently studying. 120k a year--even with interest and other ways banks give out money--what job did she have at the time of the accident?

    I dont really care either. Its ****ed up. She doesnt deserve a penny. If others are not compensated she shouldnt either.

    People getting on My case have pampered on wool and live a life of unicorns and rainbows.

    Wait for the moment something terrible happens to you or your family and you dont get a dime, maybe that will hopefully show you how the world works. Peasant with a PhD out.

    Judges are never pissed off at inflated claims in a situation like this unless the claim is inflated by $10-20M. So that potential is almost nil.

    Exactly. I'd bet this settles at around $3M, give or take. Sympathetic victim, Ceci's girlfriend is unsympathetic, and the two companies in the suit are the deep pocket corporate defendants who will be neutral at best (but more likely unsympathetic).

    I worked on a similar case in the past that settled for $6M.

    I never called you a peasant so chill out there big guy nobody cares what you do for a living. I've had somebody in my family have something terrible happen and get nothing...I'm not really talking about that at all either I'm talking about you acting like you would voluntarily take nearly being burned to death for a couple million dollars and it doesnt matter how much you not so humbly get your brag on I will not believe you. Have fun with being a key board warrior and that PhD.

    I wonder if its that simple outside of North America.

    Unless Ceci created dangerous conditions that caused the accident, his homeowner policy should have nothing to do with this.

    Im betting outside of USA/canada only Ceci's gf would be liable and her insurance company would throw out the claim due to gross negligence and the injured woman would get medical bills covered and couple of grand on top for pain and suffering, all paid directly by Ceci's gf.

    More is needed, at least under US torts law.

    Just because it is his house and his party doesn't mean he is de facto liable.
