If NHL at some point cancels the season, do they have to get some rulings from the NLRB regarding the draft? For example, whether they are forced/allowed to have a draft? Or whether article 8 applies?

Or this optional for NHL, or something they can get a ruling at a later date? Or can they just leave it to any possible draftees like Crosby and his lawyers to pursue? Wouldn't it be useful for NHL to get these kind of rulings from NLRB?

And just a thought for the future, could NHL and NHLPA agree provisions on the next CBA about a situation, where no draft is held, or on what conditions draft would be optional? Are there any legal constraints to this kind of agreement?

Do you really think that Pittsburgh or Washington would still fight for a cap if it means missing out on Crosby?

How much would missing out on Crosby cost them? They'd lose millions because even a losing team with Crosby would still sell like a winning team if Crosby comes close to delivering on his promise.

The Pengs can't afford Crosby under the current system. Better for the Pengs to have no Crosby and a harsh cap than have no Crosby (because they can't afford him) and the old CBA. If it comes down to it and I was running the Pengs I would rather have a cap than have a shot at Crosby (considering its no given they'll get 1st pick overall) under the exisiting system.

Can't afford him? That's got to be the most moronic thing I've read on here and I've read some pretty stupid things here.

They can pay Mark Recchi $3M a year but they can't afford to pay Crosby whatever the rookie maximium is?

I could give 2 left nuts about Crosby now ... his agents are slime, plain and simple...

I hope the NHL does allow replacement players, **** the PA ... if the NHL loses franchises like Edmonton because of this lockout, I won't support the league, ever.

ok .. so what happens when Crosby is 21 ... whats the problem ? under the old CBA PIT offers him a 10% raise on something like 1.3m (or less).

if he is living up to his promise, they probably dont mind a 100% raise to 2.5m or so.
if he is not living up to his promise, he wont have any leverage regardless. if he isnt even worth 1.5m or so, what difference will it make if he sits out ? he clearly isnt providing anything any other average NHL'er is and PIT can make him sit.

so whats the problem ? how has the system forced PIT to pay him anymore than they have too ?

Steve Simmons "ponders" many of the issues that were discussed in this thread several days ago.

Even though I find Steve Simmons a not quite exceptional hockey writer, he has raised many interesting points about Crosby, the Draft, and how they may mesh or clash depending on how the CBA issues are resolved or deadlocked.

Even an obviously guarded John Ferguson, Jr. is closely tracking the developments surrounding Crosby. I still don't think Crosby is going to fall into Ferguson's lap, nor do I think Crosby's future is necessarily going to shine brightest in the glow of T.O. Still, the more options Crosby keeps available, the better for him.

IMG and Crosby's agent Pat Brisson obviously are well aware they hold a pretty good hand in this situation....from Simmons' column...

"....The International Management Group, which represents Sidney Crosby, is not waiting around to see what the NHL is doing. A battery of IMG's lawyers have already investigated his options should the NHL remain locked out, should its entry draft be cancelled in June.

"Our lawyers have come up with all kinds of scenarios," said Pat Brisson, Crosby's agent. "A lot of possibilities have arisen and we have a lot of internal options floating around that I can't talk about." ..."

...."The draft is illegal".....yet another can of worms with an unlimited shelf life that can be opened up and served cold at the convenience of any player and agent who like to play hardball...
